Resumo
A evolução tecnológica proporcionada pelo petróleo ofereceu uma variedade de produtos considerados indispensáveis pela atual civilização. No entanto, junto com seus benefícios, vieram os impactos ambientais, em razão de seu potencial poluidor, de cuja categoria o óleo lubrificante faz parte. O óleo lubrificante gera dois tipos de resíduos, sendo que o primeiro é a embalagem quando comercializada e esvaziada, e o segundo é o próprio óleo que por razões técnicas de uso deve ser trocado. Esses dois resíduos devem ter o tratamento adequado para seu correto reaproveitamento ou destinação específica. Para que isso aconteça, tecnologias foram e continuam sendo desenvolvidas, contudo, há também a necessidade de se atender à legislação específica que prevê a forma adequada de reaproveitamento dos resíduos ou a destinação correta, caso não haja o reaproveitamento. No Brasil, cada tipo de resíduo possui uma legislação própria. Especificamente a do óleo lubrificante está contemplada na resolução do CONAMA 362/2005; já as embalagens estão enquadradas dentro do contexto da Política Nacional de Resíduos Sólidos (PNRS), aprovada em 2010, mas com regulamentação específica celebrada em acordo setorial no final de 2012. Tanto no que tange às questões tecnológicas quanto às questões legais, há desafios importantes para os agentes envolvidos na cadeia, tais como varejistas, comerciantes, fabricantes, importadores e consumidores, e o principal envolve não somente a montagem de esquemas de logística reversa para a coleta destes resíduos, mas também o que deriva dos resíduos de óleo lubrificantes como, por exemplo, definição de início e término das responsabilidades dos agentes, quem deve arcar com os custos inerentes a essas operações e aceitação que há uma legislação que deve ser cumprida. Nesse contexto, a presente dissertação tem por objetivo compreender tais desafios, saber como os agentes trabalham para superá-los, e ainda, tentar identificar se oportunidades estão surgindo no gerenciamento do óleo lubrificante usado e também das embalagens. Para tanto, utilizou-se uma abordagem metodológica de caráter qualitativo, com coleta de dados por meio de pesquisa bibliográfica, entrevistas exploratórias e posterior análise e interpretação dos dados obtidos. Os resultados obtidos demonstram avanços importantes na coleta e destinação desses resíduos, inclusive com boas perspectivas na origem de novos negócios. Todavia, a quantidade de agentes envolvidos e a dificuldade de consenso entre estes traz muita complexidade ao tema da logística reversa desses resíduos e será necessário grandes esforços para que se obtenham avanços mais relevantes
Technological developments provided by oil offered a variety of products considered indispensable by modern civilization. However, along with its benefits, came the environmental impacts, due to its potential pollution and lubricating oil is part of this category. The lubricating oil generates two types of waste, of which the first is the packaging when sold and emptied and the second is the oil itself that for technical reasons the use must be replaced. These two residues must take the appropriate treatment for your specific correct reuse or disposal. For this to happen, technologies have been and are being developed, however, there is also the need to conform to specific legislation that provides the appropriate way to reuse waste or proper disposal if no reuse. In Brazil, each type of waste has its own legislation. Specifically, the lubricating oil is included in the CONAMA Resolution 362/2005; since the packages are framed within the context of the National Solid Waste (PNRS), passed in 2010, but with specific rules on sectoral agreement concluded in late 201. Both regarding technology issues as legal issues, there are important challenges for those involved in the chain such as retailers, traders, manufacturers, importers and consumers, and involves not only the main assembly schemes reverse logistics for the collection of such waste, but also what derives from waste lubricating oil, for example, setting start and end of the responsibilities of agents, who must bear the inherent costs of these operations and acceptance that there is a law that must be met . In this context, this dissertation aims to understand these challenges, namely how agents work to overcome them, and also try to identify whether opportunities are emerging in the management of used lubricating oil and also the packaging. For this, it was used a qualitative methodological approach, with data collection by means of literature, exploratory interviews and subsequent analysis and interpretation of data. The results show important improvements in the collection and disposal of these wastes, including the origin with good prospects for new business. However, the number of agents involved and the difficulty of consensus between them, brings a lot of complexity to the issue of reverse logistics and waste of these great efforts to get most relevant advances will be needed
